Vermont Stands Up, Inc. Terms of Use Policy
We seek to make Vermont Stands Up, Inc. a positive experience for all. The Host sets the standards and enforces policies they expect of the community members within a Vermont Stands Up, Inc..
However, Vermont Stands Up, Inc. expects everyone using the Vermont Back Porch platform to adhere to a few basic rules of civility:
- No violation of laws or regulations or violation of intellectual property or personal rights of others. This includes, but is not limited to, the prohibition of any content deemed illegal by the United States or Vermont governments.
- No violence, threats of violence, or threats of harm.
- No harassment or attack of a person or a community.
- No sexualization of minors, nonconsensual sex trafficking, or forced labor.
- No Child Sexual Abuse and Exploitation (CSAE)
- No pornographic material.
- No viruses, malware, phishing, or spam.
Vermont Back Porch forum is a family-friendly space. Please refrain from posting graphic images or descriptions that would be obvious to young people, or other sensitive folks who may be walking by when your post is being read by a member.
2. Your Content
You keep complete ownership of all content and activity in your Vermont Back Porch posts. You give us permission to run your content, data, and activity shows up through Mighty Networks software. Make sure you have permission to use content that you post on Vermont Back Porch.
B. Your Content License to Use.
You (and the people you license Your Content from) keep complete ownership of all Your Content. By posting Your Content on the Service, you grant us a license to show it on your Vermont Back Porch, but you and your licensors still own it.
In legalese: In connection with your use of the Service, you hereby grant and will grant Vermont Stands Up, Inc. and its affiliated companies a nonexclusive, worldwide, royalty free, fully paid up, transferable, sublicensable (through multiple tiers), perpetual, irrevocable license to copy, display, transmit, perform, distribute, store, modify, and otherwise use Your Content in connection with the operation of the Service in any form, medium or technology now known or later developed, including publication and use on any Integrated Services (as defined below). This license includes the right for us to make Your Content available and sublicense rights to other entities and individuals who partner with us in the delivery of the Service, including the right of the Host of your Vermont Stands Up, Inc. to move Your Content to another platform. If you join a Network that is Paid, Private or Secret, rather than Public, only we, your Host and Members who are invited to join that Network will be able to see Your Content that you post on that Network. Mighty Software, Inc. and Vermont Stands Up, Inc. may preserve Your Content and may also disclose Your Content if required to do so by law or in the good faith belief that such preservation or disclosure is reasonably necessary to: (a) comply with legal process, applicable laws or government requests; (b) enforce these Terms of Use; (c) respond to claims that any Your Content violates the rights of third parties; or (d) protect the rights, property, or personal safety of Mighty Software, Inc., its Users and the public. The technical processing and transmission of Your Content may involve transmissions over various networks and changes to conform to technical requirements of connecting networks or devices.
C. Respect Rights in other’s User Generated Content.
As Network Members and visitors, you agree not to use, modify, reproduce, distribute, sell, license, reverse engineer, decompile, or otherwise exploit User Generated Content without the prior written permission of the User Generated Content owner. Network Members, visitors, and Hosts may not use User Generated Content in connection with: (1) the development of any software program, including but not limited to, training a machine learning or artificial intelligence (AI) system; or (2) providing archived or cached data sets containing User Generated Content to another person or entity. Except for a public search engine’s use of spiders for creating search indices, you may not use robots, spiders, scripts, services, software or any manual or automatic device, tool, or process designed to data mine or scrape the User Generated Content, data or information from the Services, or otherwise use, access, or collect the User Generated Content, data or information from the Services using automated means.
3. Copyright and Trademark Policies
The Vermont Stands Up, Inc. Copyright Policy and Vermont Stands Up, Inc. Trademark Policy are incorporated by reference into this Agreement.
If you believe that your intellectual property is being violated on the Service or the Website, you can submit a complaint and request for take-down of specific material at info@vermontstandsup.org.

At Vermont Stands Up, Inc., we expect users of our Vermont Back Porch platform/spaces to respect the intellectual property rights of others. All capitalized terms used in the Vermont Stands Up, Inc.’s Copyright Policy have the same meaning as defined in the Vermont Stands Up, Inc.’s Terms of Use, which incorporates this policy by reference into its terms.
Discouragement of Copyright Infringement
We ask users of Vermont Stands Up, Inc.’s Back Porch platform to take care to avoid infringing copyrights of others. If you infringe copyrights of others, Your Content may be removed or suspended in whole or part. It is our policy, in appropriate circumstances and our discretion, to disable and/or terminate accounts of users who repeatedly infringe or are charged repeatedly with infringing the copyrights or other intellectual property rights of others.

If There is a Copyright Complaint Against You
If you receive a notice that a posting or portion of Your Content has been removed or suspended due to a copyright complaint, that means that we removed it at the request of a content owner. If you believe your content was removed in error, you have the option to file a DMCA counter-notice (the proper format for such counter-notice is defined below). When we receive a proper counter-notice, we will forward to the party who originally complained about the alleged copyright violation. If we do not receive a notice within 10 business days that the original complainant is seeking a court order to prevent further infringement of the content at issue, we will clear the complaint from your account’s record, and we may replace the content that was removed.
How to File a DMCA Counter Notice
Please note that there are potentially serious consequences for fraudulent or bad faith submissions. Such consequences may be imposed pursuant to the DMCA under Section 512(f). Before submitting a counternotice, you should be sure that you are the actual rights holder of the content removed or that you have a good faith belief that content was erroneously removed. It is important to make sure that you understand the repercussions of submitting a false claim.
A proper counter notice should be sent by replying to the email notice you received, and it should contain the following:
- Your name, address, and telephone number
- The URLs of the content that was removed or disabled by us (copy and paste the link in the notification email)
- The following statements: I consent to the jurisdiction of Federal District Court for the judicial district in which my address is located, or if my address is outside the United States, for any judicial district in which Vermont Stands Up, Inc. is located.
